Welcome to Gurnards. By accessing or purchasing from our website (www.gurnards.co.nz), you agree to be bound by the following Terms of Service. Please read them carefully before using our site.
1. General
This website is operated by Gurnards. Throughout the site, the terms “we”, “us” and “our” refer to Gurnards.
We reserve the right to update or change these Terms at any time. Continued use of the website following any changes constitutes acceptance of those changes.
2. Products & Availability
We offer freshly roasted coffee and related merchandise (e.g. apparel, accessories). All products are subject to availability and may be modified or discontinued at any time without notice.
We reserve the right to limit sales of our products to any person, geographic region, or jurisdiction. We currently sell and ship within New Zealand, with Australian shipping launching soon.
3. Pricing & Payment
All prices are listed in New Zealand Dollars (NZD) unless otherwise stated.
We reserve the right to update pricing at any time without notice.
Payment is due in full at the time of order using the payment methods provided at checkout. Orders will not be shipped until payment has been received and confirmed.
If you're ordering from Australia, your bank may convert the purchase into AUD at your local bank rate and may apply international transaction fees.
4. Shipping
We currently ship within New Zealand. Shipping to Australia will be available soon.
Shipping timeframes are estimates only and may vary depending on your location and courier services.
Once your order has been dispatched, we are not responsible for courier delays, customs clearance times, or any additional charges such as import duties or taxes.

5. Returns & Refunds
Coffee (Perishable Goods):
Due to the perishable nature of coffee beans, we do not accept returns or provide refunds for change-of-mind purchases.
If your order arrives damaged or incorrect, please contact us at hello@gurnards.co.nz within 3 days of delivery. Include your order number and photos if applicable. We'll assess the situation and offer a resolution where appropriate.
Merchandise (Non-Perishable Goods):
Returns or exchanges for apparel and accessories are accepted within 14 days of delivery, provided items are:

Unused, unwashed, and in original condition with tags attached

Accompanied by valid proof of purchase
Return shipping is at the buyer’s expense unless the item is faulty or we made a packing error.
6. Consumer Guarantees
Nothing in these Terms overrides your rights under the New Zealand Consumer Guarantees Act 1993 or, where applicable, the Australian Consumer Law.
If a product is faulty or not as described, you may be entitled to a replacement, repair, or refund as required by law.
7. Intellectual Property
All content on this website (including but not limited to images, logos, text, and graphics) is the property of Gurnards. You may not use, reproduce, or distribute any content without written permission from us.
8. User Conduct
You agree not to misuse our website or engage in unlawful or disruptive behavior, including but not limited to hacking, data scraping, or interfering with site functionality.
9. Limitation of Liability
To the fullest extent permitted by law, Gurnards will not be liable for any indirect, incidental, or consequential damages resulting from your use of our products or website.
Our liability is limited to the purchase price paid for the product.
10. Governing Law
These Terms are governed by the laws of New Zealand.
If you are purchasing from Australia or any other country, you do so at your own risk and are responsible for complying with local laws. Any disputes shall be resolved under New Zealand jurisdiction.
